Welcome to the home page of the Steinfeld v. Discover Financial Services, et al. class action settlement. Pending in the United States District Court for the Northern District of California. (Case No. 3:12-cv-01118-JSW)
The settlement includes all persons in the United States to whom Discover Financial Services or any related parties (including Discover Bank, The Student Loan Corporation or Discover Home Loans) placed a non-emergency telephone call to a cellular telephone through the use of an automatic telephone dialing system and/or an artificial or prerecorded voice between November 30, 2007 and September 10, 2013.
The settlement claims that Discover violated the Telephone Consumer Protection Act, 47 U.S.C. ยง 227, et seq. (the "TCPA"), by placing calls on or after November 30, 2007 to cellular phones through the use of an automatic telephone dialing system or an artificial or prerecorded voice without the prior express consent of Plaintiffs and putative class members. Discover denies these allegations and denies any claim of wrongdoing.
Class Counsel estimates that settlement payments or credits will be between $20 and $40, but could be more or less based on factors including the number of claims submitted.
Settlement Class Members have the following options:
- You may submit a Revocation Request Form:
Submit a Revocation Request Form to request that Discover cease making calls to your cellular telephone number(s) using an automatic telephone dialing system or an artificial or prerecorded voice. Your Revocation Request Form must be submitted by no later than April 30, 2014.
- You may submit a Claim Form:
Submit a Claim Form to request money from the settlement in the form of a check or a one-time credit against the balance of your Discover credit card account. Your claim form must be submitted by February 25, 2014. The deadline to file a claim form has passed.
- You may request to be excluded from the settlement:
If you do not want to be legally bound by the settlement, you may exclude yourself by sending a request for exclusion to the Claims Administrator no later than January 13, 2014. The deadline to file a request to be excluded from the settlement has passed.
- You may object to the settlement:
You may object to the settlement by explaining in writing why you do not like the settlement by no later than January 13, 2014.
